Encorp is actively preparing for the implementation of recent amendments to the Designated Materials Regulation under New Brunswick’s Clean Environment Act. This regulation governs all Extended Producer Responsibility (EPR) programs in the province, including the Beverage Containers Program (BCP). All producer responsibility organizations (PROs), including Encorp Atlantic, must comply with the revised Regulation 2024-37 by January 1, 2026. If you haven’t already, we strongly encourage you to review the updated regulation.
To meet these regulatory requirements, Encorp must revise and resubmit its Stewardship Plan for the EPR Beverage Containers Program to Recycle NB by June 30, 2025. We will notify and communicate the revised plan with all of our stakeholders once it receives approval.
The most significant change in the revised Regulation 2024-37 is the transition from the current “brand owner” definition to a new “producer” definition, which will determine who is obligated for designated materials under EPR starting January 1, 2026.
In the summer and fall of 2026, we will contact all our registered brand owners with more details. We will inform you if an update or amendment to your current agreement with Encorp is required for January 1, 2026. We anticipate that some organizations (but very few) currently registered with Encorp may no longer be obligated post January 1, 2026. In such cases, their obligation to report and remit Program fees to Encorp would end on December 31, 2025, and their existing agreement with Encorp would most likely be terminated after that date. We will provide clear guidance based on your specific situation.
